Changing Scale of my worker role fails, I have checked with Azure Billing support and I am within my number of core instances

1) I am under my core limit - validated that with ms support ticket 114042611393839 and 114032811304446

2) when I scale from 1 to 3 instances of a worker role this fails

3) this same package scales fine in other subscriptions

The Error I get: Failed to change the scale settings for the production deployment of cloud service stagingrateservice.

Any Ideas?
